Terms & Conditions of Equipment Hire:
1 · Equipment Use & Care
1.1 You agree to use all hired items — including but not limited to clear kayaks, paddleboards, snorkel sets, beach cabanas, deck-chairs, umbrellas, bodyboards, windbreaks and e-bikes — only for their intended recreational purpose and in a safe, responsible manner.
1.2 All equipment must remain on Waiheke Island for the duration of the hire.
1.3 Treat the gear as if it were your own. Report any damage or issues immediately.
1.4 You are liable for any loss, theft, excessive wear or damage resulting from misuse, negligence or failure to follow instructions. A bond may be required to cover such costs.
2 · Return, Late Fees & Bonds
2.1 Return all equipment by the agreed finish time. A grace period of 15 minutes applies; thereafter a full extra-hour charge is incurred.
2.2 Hired items are for your party only and may not be lent or sub-hired.
2.3 A refundable bond may be required at the time of hire. The bond is released once all items are returned in satisfactory condition.
3 · Risk Disclosure
3.1 You acknowledge that water sports and beach activities carry inherent risks that could result in injury or property damage.
3.2 By proceeding with the hire you accept full responsibility for those risks and release WATSUP Waiheke, its owners and staff from all liability for injury, loss or damage arising from your use of the equipment.
4 · Liability Waiver & Safety
4.1 You agree to operate all equipment safely, follow staff instructions, observe local bylaws and supervise children at all times.
4.2 WATSUP Waiheke is not liable for accidents, injuries or damages resulting from misuse or unsafe operation.
5 · Cancellations & Weather
5.1 Cancel 48 hours or more before your booking for a full refund, 24 hours - 47 hours, 50% refund.
5.2 No refunds are given for cancellation less than 24 hours, no-shows, change of mind, or early returns once the hire has commenced.
5.3 In cases of illness, bookings may be rescheduled at WATSUP Waiheke’s discretion.
5.4 We reserve the right to cancel or shorten your booking and dismantle setups at any time due to unsafe weather, sea conditions or unforeseen circumstances. A pro-rated refund will be provided if WATSUP Waiheke initiates the cancellation.
6 · Operational Support
6.1 Use the equipment in accordance with the safety guidelines supplied.
6.2 Lower cabanas or umbrellas if winds exceed approximately 12 mph (20 km/h) to prevent damage.
6.3 Should you require assistance or pickup outside normal operating hours, a call-out fee may apply.
7 · Group & Third-Party Responsibility
7.1 For group bookings you confirm that all participants have been informed of, and agree to, these terms.
7.2 You accept responsibility for each item hired and for the conduct of every member of your group.
8 · Privacy
Our privacy statement is available on our Privacy Policy page. By using our services you consent to the collection and handling of personal information as outlined there.
9 · Website Terms & Disclaimer
